Terms of Service

1. Acceptance of Terms

By downloading, installing, or using TrailStory (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms apply to all users, including free and Premium subscribers.

2. Eligibility

You must be at least 13 years old to use TrailStory. By using the App, you confirm that you are 13 or older. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate and complete information when creating an account
  • Notify us immediately at support@trailstory.app if you suspect unauthorized access

4. Acceptable Use

You agree NOT to:

  • Use the App for any unlawful purpose
  • Upload content that is offensive, defamatory, or infringes third-party rights
  • Attempt to hack, reverse-engineer, or disrupt the App or its servers
  • Use automated tools to scrape or extract data from the App
  • Impersonate another person or entity
  • Share your account credentials with others

5. Content You Create

5.1 Your Content

You retain ownership of all content you create using TrailStory — your photos, hike routes, and generated cards.

5.2 License to Us

By using TrailStory, you grant us a limited, non-exclusive license to store and process your content solely to provide the App’s services. We do not use your content for advertising or sell it to third parties.

5.3 Content Responsibility

You are solely responsible for the content you share. Do not upload photos or content that you do not have the right to use.

6. AI-Generated Content

  • AI captions and insights are generated based on your hike data using OpenAI
  • AI-generated captions are suggestions — you can edit or replace them at any time
  • We are not responsible for the accuracy of AI-generated content
  • Do not rely on AI content for safety-critical decisions

7. Premium Subscription

7.1 Plans

  • Monthly plan: $4.99/month
  • Annual plan: $34.99/year (billed annually, save 42%)
  • -day free trial available for new subscribers

7.2 Billing

  • Subscriptions are billed through the Apple App Store or Google Play Store
  • Payment is charged to your store account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date

7.3 Cancellation

  • Cancel anytime through your device’s subscription settings
  • iOS: Settings -> Apple ID -> Subscriptions -> TrailStory
  • Android: Google Play -> Subscriptions -> TrailStory
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods

7.4 Free Trial

  • One free trial per user
  • If you do not cancel before the trial ends, you will be charged the subscription price

7.5 Price Changes

  • We will notify you of price changes at least 30 days in advance
  • Continued use after the effective date constitutes acceptance of new pricing

8. Safety Disclaimer

IMPORTANT SAFETY NOTICE TrailStory is a hiking tracking and content creation app. It is NOT a navigation or safety app. Do not rely on TrailStory for navigation in remote areas. Always carry appropriate safety equipment when hiking. We are not responsible for accidents, injuries, or losses that occur during or after hikes.

9. Intellectual Property

All content in TrailStory — including the app design, logo, icons, and software — is owned by TrailStory and protected by copyright and trademark law. You may not copy, modify, or distribute our intellectual property without written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • TrailStory is provided “as is” without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the App
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time in Settings -> More -> Delete Account.

12. Governing Law

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of San Francisco County, California.

13. Changes to Terms

We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the App after changes constitutes acceptance.
